Lawsuit: Tenant lost two toes because of landlord's negligence

MEDIA - A Boothwyn apartment complex faces an injury liability complaint after a neglected apartment repair allegedly resulted in injury. 

The complaint was filed by plaintiffs Donald and Elizabeth Doyle on May 10 in the Delaware County Court of Common Pleas against defendant Chichester Apartments LLC. Chichester owns the Willowbrook Apartments at 3360 Chichester Ave. in Boothwyn. 

According to the complaints, the Doles had submitted several repair requests to the defendant for their apartment that had gone unanswered, including a metal threshold connecting the tile of the kitchen with the carpet in another room that was not properly affixed. 

On January 30, 2020, Donald Doyle allegedly was walking over the threshold when his toe caught on the threshold and sustained a deep wound ultimately resulting in amputation of two toes.

The defendant is sued for negligence and loss of consortium totaling at least $100,000 in damages requested. 

The plaintiffs are represented by Schmidt, Kirifides and Rassias PC.
