Golf course, cart supplier face suit after brakes allegedly fail, cause man to be ejected

MEDIA — A golf club and its cart supplier are facing a lawsuit after a man allegedly suffered serious injuries when the cart's brakes failed. 

Harry P. Gallagher filed a complaint May 27 in the Court of Common Pleas for Delaware County against Paxon Hollow Golf Club and Golf Car Specialties LLC alleging negligence. 

Gallagher claims in his suit that he was a passenger on a golf cart on Aug. 30, 2019, which was owned by Golf Car and leased to Paxon Hollow. He alleges that as the cart was going down a hill, the brakes "malfunctioned" and caused the cart to crash into a tree. 

Gallagher claims he was thrown from the cart and suffered "meniscal tears, facial laceration," as well as a "metal fragment" in his left temple, permanent scarring and contusions to his knee, calf and shoulders. He also claims he suffered rotator cuff, soft tissue and neck and lumbar injuries which required months of physical therapy. 

Gallagher claims negligence on the part of Golf Car for providing a defective golf cart and failing to inspect and maintain the cart's brakes. He claims the negligence of Paxon Hollow for failing to remove the cart from use and failing to warn him of the cart's "unreasonably dangerous condition." 

Gallagher seeks monetary relief of more than $50,000, trial by jury and all other just relief. He is represented by William Myers, Jr., of the Myers Firm in Philadelphia.
