Old Navy employee allegedly threw shelving at customer

PHILADELPHIA — Old Navy is facing a lawsuit after an employee at one of its Philadelphia stores allegedly threw metal shelving at a customer. 

Joy Battle filed a complaint earlier this year in the Court of Common Pleas of Philadelphia County against Old Navy LLC and The Gap Stores Inc., alleging negligence. On May 25, the defendants removed the case to federal court.

Battle claims while shopping at the Old Navy store in Northeast Town Center in Philadelphia on June 8, 2019, an Old Navy employee engaged in a verbal confrontation with her while at the checkout counter over "the improper cost of a clothing item."  

Battle alleges that as she attempted to leave the store, Doe took a piece of metal shelving and threw it at her and struck her in the head. Battle also alleges she suffered a head laceration, headaches, "post-concussional syndrome," exacerbation of her pre-existing psychological condition, memory loss and vision and balance issues as well as cardiac issues. She further alleges that the store security guard failed to contact the store manager or law enforcement and that the employee "had a propensity for violence." 

Battle claims Old Navy failed to properly screen and train its employees and failed to properly supervise or monitor its workers. 

Battle seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. She is represented by Carin O'Donnell and Ryan Kilmer of Stark & Stark PC in Yardley.
