Lawsuit: Cyclist with head down ran over man who had stopped to help other cyclist

MEDIA — A man who was allegedly struck by another bicyclist on the Schuylkill River Trail and suffered multiple injuries is claiming negligence. 

David Paul Moyer and Melody Moyer filed a complaint July 29 in the Court of Common Pleas of Delaware County against James J. Piasecki alleging negligence. 

Paul Moyer was riding his bicycle at the Schuylkill River Trail on June 18, 2021, according to the plaintiffs' complaint. They allege that after Moyer had stopped to assist another biker who had trouble with their bicycle. 

Piasecki, who was riding his own bicycle, ran him over and caused him to suffer serious ad permanent injuries, the suit claims. Specifically, the plaintiffs claim Moyer suffered injury to his brain, head, neck, ribs, liver and organs, back, spine and other areas. 

They further claim that Piasecki admitted to police that "he was riding with his head down" when he struck Moyer. The plaintiffs allege Piasecki's negligence for riding his bicycle in a careless manner and for failure to keep his bicycle under control in order to be able to stop "within the assured clear distance ahead." They also allege Piasecki was operating his bicycle at an excessive rate of speed and failed to keep a proper lookout. 

The plaintiffs seek monetary and all other proper relief. They are represented by James Sutton, III of The Law Offices of James W. Sutton, III in Feasterville.
