Lawsuit alleges forklift crushed man's foot

PITTSBURGH — A man who says he suffered a crush injury to his foot after being run over by a forklift at a wholesale distributor business is alleging negligence. 

Robert Zagrocki filed a complaint July 30 in the Court of Common Pleas of Allegheny County against Standard Air & Lite Corporation alleging negligence. 

Zagrocki, according to his complaint, was working for Mitchell Plumbing, Heating and Cooling and picking up supplies at the defendant's business on May 26, 2020. He alleges that while on the premises, one of the defendant's employees ran over his foot with a forklift and that when he attempted to remove his foot from under the forklift, he suffered a "sheering injury/laceration" on the bottom of his foot. 

Zagrocki further alleges that he was transported to UPMC Mercy Hospital and was found to have fractures to his third, fourth and fifth metasarsal bones and required surgery on May 27, 2020. He claims the defendant's negligence for failing to properly train its forklift operator and failing to have safety measures in place to protect customers and visitors. Zagrocki also claims the defendants failed to have a warning device such as backup alarm on the forklift and should not have allowed individuals to stand near the loading docks and forklifts.   

Zagrocki seeks monetary relief, trial by jury and all other just relief. He is represented by Jason Tetlow of Tetlow Law PC in Pittsburgh.
