PITTSBURGH — The manufacturer and installer of metal fabric buildings is facing a breach of express warranty lawsuit alleging one of its equine structures was defective.
Kathleen Hartford filed a complaint Aug. 9 in the Court of Common Pleas of Allegheny County against Clearspan Fabric Structures International Inc., alleging breach of express warranty.
Hartford purchased a indoor horse riding area from Clearspan on Feb. 25, 2013, for $170,427.51, according to her complaint. She alleges that the riding arena was installed by Clearspan on April 23, 2013, at a property on Alter Road in Natrona Heights.
Hartford claims that she discovered a large tear in the arena's fabric cover in January of 2021, which has caused her repair costs, downtime and loss of use of the arena and other damages. She also claims in her suit that the tear of the fabric "after only 7 years" constitutes breach of implied warranty and that the defendant's agent warranted the fabric cover "was tear resistant and guaranteed free from defect for a period of 15 years."
Hartford seeks monetary relief, trial by jury and all other just relief. She is represented by Avrum Levicoff of The Levicoff Law Firm PC in Pittsburgh.
