PITTSBURGH — A bicyclist who suffered severe injuries on a bike path in Pittsburgh after hitting a chain that had been laid on the road in between two concrete barriers is claiming negligence.

Thomas H. Brown and Gina Brown filed a complaint in the Court of Common Pleas of Allegheny County against Allegheny Valley Railroad Company and Carload Express alleging negligence.

According to the Browns' complaint, Thomas Brown was riding his bicycle on a lined, designated bike path on Railroad Street in Pittsburgh on Oct. 15, 2020. The plaintiffs claim Brown struck a chain that had been placed in the road by the defendants between two concrete barriers which caused him to flip forward onto the street and strike his head and neck.

They allege that as a result of the bike accident, Brown suffered central cord syndrome paresthesia, numbness and disability in his hands, legs and groin, injury to his arms and shoulders, a fracture, spine compression and difficulty with maintaining balance. The plaintiffs also claim Brown suffered lost wages and that they have incurred medical treatment expenses as a result of Brown's injuries. The Browns allege the defendants' negligence for placement of the chain without a reflector or bright color to warn of the hazard and for placing the chain too low for bicyclists and pedestrians to see.

The Browns seek monetary relief of more than $35,000, trial by jury and all other just relief. They are represented by Regis McClelland of The McClelland Law Group PC in Pittsburgh.
