Bicyclist alleges Trek bike's front suspension failure caused fall to pavement

State Court
Courtroom

PITTSBURGH — A bicyclist alleges the front suspension failure of her Trek bicycle caused her to violently fall to the pavement and suffer injuries.

Sandra Barr and Timothy Barr filed a complaint Aug. 26 in the Court of Common Pleas of Allegheny County against Trek Bicycle Corporation and National Velo Inc., doing business as Trek of Pittsburgh, alleging strict liability and negligence.

Sandra Barr was riding her Trek bicycle in North Park in Allegheny County on Sept. 2, 2019, according to the plaintiffs' complaint. They claim that she was riding up a low-grade hill when the bike's "fork dropout of the front suspension fork broke" and caused her to violently fall and hit the pavement.

The plaintiffs claim as a result of the accident, Sandra Barr suffered fractures, a chin laceration, disfigurement and other serious injuries that have required medical treatment and surgery and caused them to incur medical bills. They allege the defendants were negligent in the design and manufacturing of the bicycle and failed to provide all features to render the bicycle and its parts safe.

The Barrs further allege the defendants failed to warn of the dangers of the bicycle and that its component parts could break and cause the rider to lose control during ordinary use.

The Barrs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Daniel Schiffman and Jason Schiffman of The Schiffman Firm LLC in Pittsburgh.
