Plaintiffs Sue Retailer Over Negligence Resulting in Slip-and-Fall Injury

Theresa Mulloy, a resident of Pennsylvania, has filed a lawsuit against Kohl's Pennsylvania, Inc., Division Maintenance Group, Inc., and J&C Property Management. The complaint was filed on April 23, 2025, in the Court of Common Pleas of Delaware County, Pennsylvania. Mulloy alleges that she suffered injuries due to negligence related to unsafe conditions on the property owned and maintained by the defendants.

The case revolves around an incident that occurred on January 16, 2024. Theresa Mulloy claims she was injured when she slipped and fell in the parking lot of a Kohl's store located at 1067 W. Baltimore Pike in Media, Pennsylvania. According to the complaint, the fall was caused by an "unreasonably slippery, dangerous, and defective condition" on the parking lot surface. The lawsuit accuses Kohl's and its co-defendants of failing to maintain safe premises by not adequately removing snow and ice or warning patrons about potential hazards.

Mulloy's attorney, Thomas A. Musi Jr., argues that the defendants had both actual and constructive notice of these hazardous conditions but failed to take appropriate action to rectify them. The complaint asserts that this negligence resulted in serious injuries for Mulloy, including cervical spondylosis and lumbar strain among others. It further states that these injuries have led to significant physical pain and emotional distress for Mulloy.

The plaintiffs are seeking damages exceeding $50,000 from each defendant for negligence and loss of consortium claims. Charles Mulloy Sr., Theresa’s husband, is also named as a plaintiff in the suit seeking compensation for loss of companionship and support due to his wife's injuries.
