Chester County charter school faces negligence claim after student pushed off slide

MEDIA — A Chester County charter school is facing a negligence claim after a student was pushed off a slide and suffered multiple injuries including a fractured leg. 

J.M., a minor by and through her parent and natural guardian Kannirha Scott Moseley and Kannirha Scott in her own right filed a complaint Sept. 5 in the Court of Common Pleas of Delaware County against Chester Community Charter School-East, SSMI LLC, John Does I and II and XYZ Company alleging negligence. 

According to the plaintiffs' complaint, J.M., was a student at Chester Community Charter School. They allege that on Sept. 6, 2019, J.M., was pushed off a sliding board by another student and suffered a buckle fracture and other injuries to his bones as well as injury to his tendons, ligaments and nerves that resulted in medical treatment expenses of more than $1,500. The plaintiffs claim the defendants failed to properly inspect, repair or maintain the area where J.M., fell and that Chester Community Charter failed to properly supervise the students and protect J.M., from the actions of other students at the school. 

The plaintiffs seek monetary relief of more than $50,000 and all other just relief. They are represented by Kenneth Saffren of Saffren & Weinberg in Jenkintown.
