Lawsuit: Unlevel concrete slabs on sidewalk caused woman's fall, hip fracture

PITTSBURGH — A woman who tripped over unlevel concrete slabs on the sidewalk in the McKees Rocks Borough and suffered a fractured hip and other injuries is claiming negligence. 

Michelle Barnes filed a complaint July 28 in the Court of Common Pleas of Allegheny County against McKees Rocks Borough and NILU Enterprises Inc., alleging negligence. 

According to her complaint, Barnes was walking along the sidewalk of NILU's premises on Oct. 5, 2019, located in the McKees Rocks Borough. She claims that she tripped and fell over concrete slabs "that were of varying heights and levels" and landed onto the sidewalk on her left side. 

She claims the defendants' negligence for allowing the hazardous condition to exist and failing to warn of the danger. Barnes also claims McKees Rocks Borough failed to cordon off the dangerous condition and negligently designed, constructed and maintained the sidewalk. She alleges that as a result of her trip and fall she suffered a fractured wrist and hip which required surgeries, multiple contusions, abrasions and bruises as well as sprains to her arm, shoulder, wrist, hip and leg. 

Barnes seeks monetary relief, interest, trial by jury and all other just relief. She is represented by G. Christopher Apessos of Apessos Law LLC in Pittsburgh.
