Man sues pub and individual for physical altercation

PITTSBURGH -- A man is suing a pub and individual after a fight allegedly caused him personal injury. 

Daniel Nolan and Kathleen Gapsky filed a complaint on October 14 in the Court of Common Pleas of Allegheny County against NPL Holdings, Inc. d/b/a Barry's Pub, and Brent Werth for negligence, Dram Shop liability, battery, assault, negligent infliction of emotional distress and loss of consortium. 

According to the complaint, on Dec. 30, 2019, Nolan was a patron in Barry's Pub. Nolan alleges that Barry's Pub served alcoholic beverages to Brent Werth, who became visibly intoxicated. Werth allegedly tried to take Nolan's seat in one incident and was asked to leave by bartenders in another incident. 

Barry's Pub did not have a bouncer or security personnel, the suit says. Nolan alleges that while he and Werth were sitting watching hockey, he asked Werth to stop being obnoxious and disruptive to other patrons and Werth responded by punching Nolan in the head, which later required stitches. Nolan and Gapsky are represented by Bianca M. DiNardo.
