Casino cashier sues over FMLA dispute

PHILADELPHIA - Mark Fosbenner filed a federal complaint on October 22 in the Eastern District of Pennsylvania against Sugarhouse HSP Gaming Prop, GP, LLC d/b/a Rivers Casino Philadelphia f/k/a Sugarhouse Casino for discrimination and retaliation.

According to the complaint, on August 30, 2010, Plaintiff was hired for the position of Cage Cashier and was later promoted to the position of Cage Shift Manager in March 2012. On August 30, 2019, Plaintiff was approved for FMLA medical leave due to a disability. 

On September 11, 2019, Plaintiff was released back to work without restrictions, but Human Resources Representative Hillary Davie advised Plaintiff he was unable to return to work until September 29, 2019, because Davie was working on accommodations for him, the suit says. 

On October 17, 2019, Plaintiff received an epidural to treat his lower back. On November 13, 2019, Plaintiff was called into the HR office and was told that within 72 hours, a decision had to be made whether to accept a demotion or resign, the suit says.

Fosbenner seeks wages, front pay, and bonuses for at least $150,000. Fosbenner is represented by Brendan Mehler of Murphy Law Group, LLC.
