Man's lawsuit claims there was pebble in Aldi's potato salad

PITTSBURGH — A man claims he suffered serious dental injuries after eating potato salad he purchased from an Aldi's grocery store that contained a rock or pebble. 

Michael Topp filed a complaint Nov 30 in the Court of Common Pleas of Common Pleas of Allegheny County against Aldi Inc., and Reser's Fine Foods Inc., alleging negligence. 

Topp alleges that on May 2, 2020, he consumed potato salad he purchased from Aldi's prepackaged food section. He claims that as he ate the potato salad, he encountered a "hard foreign contaminate" that seemed to be a rock or pebble which caused severe damage to several of his teeth. 

He further claims the potato salad had been unopened. Topp alleges Aldi's negligence for allowing the contaminate in its product, for failing to have appropriate quality control and for failing to recall the product. He claims as a result of the incident, he required surgical extraction of some of his teeth.

Topp seeks monetary relief of more than $35,000, trial by jury and all other just relief. He is represented by Michael Balzarini of Balzarini & Watson in Pittsburgh.
