Suit alleges Kane Community Living Center's negligent care led to patient's death

PITTSBURGH — The estate of a former Kane Community Living Center nursing home resident is alleging negligent care led to her death. 

Nancy L. Mann, individually and as administratrix of the Estate of May Henson, deceased, filed a complaint in the U.S. District Court for the Western District of Pennsylvania against Allegheny County, as owner and operator of John J. Kane Regional Center - Ross Township doing business as Kane Community Living Center. 

According to the plaintiff's complaint, May Henson was admitted to Kane after a hip fracture in 2017 and was at high risk for falls. The plaintiff claims that during her residency at Kane, Henson suffered "at least two documented falls" in November and December of 2019, with one fall resulting in her suffering a broken clavicle, broken humerus and a forehead laceration.  

The suit further claims that despite those falls, Kane failed to change Henson's fall care plan and precautions and that the facility was cited on multiple occasions for failure to comply with federal regulations including not keeping its residents from hazards, supervision and devices and free from abuse and neglect. The plaintiff alleges that after her injuries, Henson's condition "gradually declined" prior to her death on July 1, 2020. 

The plaintiff seeks monetary relief of more than $75,000, interest and all other just relief. She is represented by Mark Troyan of Robert Pierce & Associates PC in Pittsburgh.
