Lawsuit: Woman fell in hole left by plumbing contractor

PITTSBURGH — A couple claim the wife fell into a hole on their property that was left by a plumbing company doing work in their mobile home park.

Eileen Thomas and Edwin Thomas filed a complaint Dec. 12 in the Court of Common Pleas of Allegheny County against Tom Meyers Heating & Plumbing Inc., and Virginia Hills West LP alleging negligence. 

According to their complaint, the plaintiffs' home was in a mobile home park owned by Virginia Hills West, which hired Tom Meyers Heating & Plumbing in July of 2020 to perform plumbing services and connection of water and sewage. The plaintiffs allege that after the work was completed, a hole was left on their lawn and on July 17, 2020, Eileen Thomas exited her home to walk their dog when she fell into the hole. 

The plaintiffs claim Eileen Thomas suffered blunt force trauma to her upper extremity, a dislocated shoulder that required surgery and as other injuries. They allege the defendants allowed the hazardous condition to exist on the premises for an unreasonable period of time, failed to warn of or cordon off the dangerous condition. They also claim the defendants are negligent for failing to properly inspect and repair the premises. 

The plaintiffs seek monetary and all other just relief. They are represented by G. Christopher Apessos of Apessos Law LLC.
