Homeowners face lawsuit after guest slips on unsecured pool ladder, suffers injuries

PITTSBURGH — A couple are facing a negligence claim after a visitor to their home slipped off an allegedly unsecured pool ladder and suffered multiple injuries. 

Rhonda McDonough filed a complaint Jan. 18 in the Court of Common Pleas for Allegheny County against Evan Williams and Brandi McDonough alleging premises liability and negligence. 

McDonough alleges in her complaint that she was at the defendants' premises in New Kensington on Aug. 23, 2020. She claims that as she was exiting the defendants' pool, she slipped off the pool ladder which was improperly installed and suffered fractures, a rotator cuff tear and other injuries which caused her to require medical treatment and incur financial loss. 

McDonough alleges the defendants failed to hire a contractor to set up and/or repair the ladder, failed to warn of the hazard and failed to make sure the poles, legs and uprights on the ladder were securely braced and balanced. She also alleges the defendants failed to install the pool ladder on a flat or stable surface or install the ladder according to the manufacturer's instructions. . 

McDonough seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. She is represented by Jacqueline Morgan of Lowenthal & Abrams PC in Bala Cynwyd.
