Lawsuit alleges woman fell ill after eating breakfast at Perkins

MEDIA — A woman alleges she became seriously ill after eating breakfast at a Perkins in Drexel Hill. 

Monique Chambliss filed a complaint Jan. 25 in the Court of Common Pleas of Delaware County against Perkins LLC, Perkins Restaurant and Bakery, Seravalli Restaurants Inc., and John Does 1-10 alleging negligence. 

Chambliss, according to her complaint, was at Perkins Restaurant and Bakery on Landsdowne Avenue in Drexel Hill on Feb. 2, 2020. She alleges that she ordered eggs with cheddar, smoked pork sausage, French Toast and hot chocolate and that the food was expired, spoiled "or otherwise not fit for human consumption." 

Chambliss further alleges she suffered food toxicity, viral gastroenteritis, nausea, diarrhea and other digestive issues as a result of eating the food. She claims the defendants' negligence for failing to properly prepare, assemble and distribute the food items, failing to inspect or test the food prior to distribution and for failing to warn that her breakfast sandwich was in a dangerously defective condition. 

Chambliss seeks monetary relief of more than $50,000, interest and all other just relief. She is represented by Michael T. Van Deer Veen of Van Deer Veen, Hartshorn & Levin in Philadelphia.
