Baling machine manufacturer faces lawsuit after worker loses arm

SCRANTON — A baling machine manufacturer is facing a claim its improper installation caused a worker to suffer injuries including the amputation of his arm. 

J.V. Manufacturing Inc., doing business as Cram-A-Lot filed a complaint Feb. 22 in the Court of Common Pleas of Lackawanna County against Dematic Corporation and Dematic Corp. The defendant has removed the case to federal court.

According to J.V. Manufacturing's complaint, the "underlying plaintiff Michael Dunsmore" suffered injuries on Dec. 30, 2015, at a Walmart Distribution Center in Tobyhanna while operating a baling machine which was sold and installed by Dematic. The plaintiff alleges that the subject baler was incorrectly and improperly installed by changing the layout and design of the machine's original condition at the time of manufacture and delivery.

It further alleges Dunsmore suffered serious injuries including the amputation of his left arm during his use of the baling machine. The plaintiff also claims the defendants negligently created a dangerous and defective condition "of an otherwise safe machine."

J.V. Manufacturing seeks more than $50,000 and all other just relief. They are represented by Allen Bunker of Bunker & Ray in Philadelphia.
