PITTSBURGH — A bicyclist claims Columbia Gas and its contractor failed to fix a protrusion in the roadway caused by an underground gas line which caused her to suffer injuries.

Margaret M. Kelly and Carl Kelly filed a complaint March 11 in the Court of Common Pleas of Allegheny County against 1800 Washington Road Associates and Columbia Gas of Pennsylvania, Inc., alleging negligence.

According to the plaintiffs' complaint, Margaret Kelly was riding her bicycle near the intersection of Siena Drive and Lucca Lane in the Township of Upper St. Clair on July 8, 2020. She claims she suddenly came upon a "large, raised bump, buckle or protrusion" on the surface of the road that was about the size of a speed bump.

Kelly alleges she flipped over the handlebars of her bike, struck the pavement head-first and suffered a bone fracture, torn rotator cuff, a torn bicep, a concussion, bruises, contusions and muscle and tendon damage. She claims Columbia Gas, which contracted with Washington Road to construct and maintain the gas line underneath the road, failed to warn of the raised bump in the road, failed to cordon off or block access to the area or provide a detour route for bicyclists.

She also claims Columbia gas failed to supervise and oversee its contractors and subcontractors.

The plaintiffs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Benjamin Kelly of Friday & Cox LLC in Pittsburgh.
