Tenants claim Pittsburgh apartment complex violated ADA with failure to have wheelchair ramp

PITTSBURGH —  Tenants of a Pittsburgh apartment complex claim lack of a wheelchair ramp caused them to fall down the building's entryway stairs.   

Matthew Nolen and Bridget Nolen filed a complaint May 12 in the Court of Common Pleas of Allegheny County against P&R Properties LP alleging negligence. 

The Nolens claim in their suit that they were tenants of the defendant's apartment building on Washington Road in Pittsburgh. They claim that on Aug. 28, 2021, Matthew Nolen was exiting the main entryway of the apartment complex while helping his wheelchair-bound wife. The Nolens further claim that there was no ramp on the premises and that Matthew Nolen had to navigate his wife's wheelchair down six concrete steps when he lost his balance. 

According to their complaint, Matthew Nolen fell down the steps, struck his head and shoulder on an iron bench and his wife fell on top of him. They allege P&R's negligence for failing to comply with ADA requirements, failing to warn of the hazardous condition and for failing to cordon off the dangerous entryway. The Nolens also allege P&R was negligent for failing to maintain and inspect its entryway and ensure it was accessible to persons in wheelchairs.

The Nolens seek monetary relief, interest, trial by jury and all other just relief. They are represented by Ian Watt of Friday & Cox LLC in Pittsburgh.
