MEDIA — A mother alleges a defective swing set at an Aston playground caused her daughter's serious injuries.
Lynda Arrants, individually and as parent and natural guardian of A.S., a minor, filed a complaint June 8 in Court of Common Pleas against Aston Township and Kompan, Inc., doing business as Kompan USA and Canada alleging negligence, breach of warranties and other claims.
According to the plaintiffs' complaint, A.S. was at the "Smiles in the Playground" on Concord Road in Aston with her mother on Nov. 9, 2021. They allege that while A.S. was on the swing, it suddenly detached from the structure, threw her in the air and caused her violently hit the ground. The plaintiffs claim as a result of her fall, A.S. suffered injuries to her neck, face, eyes, ribs and chest and suffers from headaches, dizziness and "impaired cognitive functioning."
They allege the defendants had actual knowledge that their playground equipment and component parts failed in tests and could result in foreseeable injury. They further allege the defendants failed to properly inspect the playground equipment, repair the defective swing set, properly instruct its employees on maintenance and did not warn members of the general public about the dangerous condition. The plaintiffs claim the subject swing was unreasonably dangerous due to lacking safety equipment that would have prevented the failure of the chain and hinge mechanism.
The plaintiffs seek monetary relief of more than $50,000, interest, trial by jury and all other just relief.
