Woman alleges Giant Eagle employee struck her with merchandise cart

PITTSBURGH — A woman alleges she suffered injuries at a Giant Eagle store after being struck from behind by an employee pushing a merchandise cart. 

Marion Criscella and Louis Criscella filed a complaint July 11 in the Court of Common Pleas of Allegheny County against Giant Eagle Inc., alleging negligence. 

Criscella, according to her complaint, was at the Giant Eagle on Towne Centre Drive in Wexford on Jan. 28, 2021. She alleges that a Giant Eagle employee who was pushing a cart behind her that was stacked with bins and objects that obstructed the view pushed the cart into her body. Criscella claims she suffered injuries to her foot and ankle; suffered bruising and swelling; and continues to have numbness, tingling and burning in the injury area. 

She alleges Giant Eagle was negligent for allowing the employee to push the cart with an obstructed view in an area around shoppers and failing to properly train its employees on preventing injuries. Criscella claims Giant Eagle also failed to enforce and implement state and federal regulations including OSHA regulations and that its employee failed to warn customers about the approach of the moving wheeled cart. 

Criscella seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Gary Ciao of Ciao, Torisky & O'Connor LLC in Pittsburgh.
