Lawsuit: Obese man strapped to gurney for transport was flipped onto ground

PITTSBURGH — A man is alleging negligence after his gurney allegedly flipped over during a medical transport.

Jeffrey Fillmore filed a complaint in the Court of Common Pleas of Allegheny County against Medevac Ambulance Service alleging negligence. 

Fillmore, according to his complaint, suffered from "morbid obesity" and lacked physical strength to walk. He claims that on Aug. 10, 2020, Medevac provided transportation for him from UPMC Presbyterian and UPMC Mercy Hospitals and that he repeatedly stated that his weight was not evenly distributed on the gurney.

Fillmore claims that the gurney flipped onto its side while he was strapped in and caused him to fall to the hot ground where he remained for several minutes and was unable to move. He alleges as a result of his fall, he suffered a fractured arm, pain in his neck and back and other injuries. 

Fillmore alleges Medevac's negligence for allowing him to remain in a dangerous and hazardous condition and for failing to provide adequate care to accommodate his medical issues. He also alleges Medevac was negligent for ignoring his repeated requests to be adjusted onto the gurney during is transport. 

Fillmore seeks monetary relief, interest, trial by jury and all other just relief. He is represented by G. Christopher Apessos of Apesso Law LLC in Pittsburgh.
