Suit: Man injured by hanging ceiling panel on pedestrian walkway at Pittsburgh's Gateway Center

PITTSBURGH — A couple allege the husband suffered serious injuries to his head after running into a ceiling panel that was hanging down in a pedestrian tunnel at the Gateway Center in Pittsburgh. 

Donald Johnston and Diana Johnston filed a complaint Aug 22 in the Court of Common Pleas of Allegheny County against City Surveillance LLC also known as Surveillance Pittsburgh alleging negligence. 

According to the Johnstons' complaint, Donald Johnston was walking through the pedestrian tunnel from Gateway Center at the Wyndam Hotel to the parking garage on Nov. 18, 2021. They claim that City Surveillance was performing maintenance and installing equipment near the tunnel and left an overhead panel open in the tunnel. 

The Johnstons allege that the panel had a "razor sharp edge" hanging down from the ceiling and into the pedestrian walkway, which caused Donald Johnston to gash his head. They further alleged he suffered a laceration and scarring to his scalp, injury to his head, numbness and tingling of the scalp disfigurement and other damages. The plaintiffs claim City Surveillance's negligence for failing to inspect the pedestrian tunnel, for allowing the ceiling panel to hang down and intrude on the walkway and for not warning about the hazardous condition. They also claim City Surveillance failed to barricade the area or enforce adequate safety precautions. 

The Johnstons seek monetary relief, trial by jury and all other just relief. They are represented by Andrew Leger, Jr., of The Law Office of Andrew J. Leger, Jr., PC in Pittsburgh.
