Elderly woman alleges wet floor at Wendy's caused her fall

LANCASTER — An elderly woman who slipped on a wet floor at a Wendy's in Lititz is claiming negligence. 

Naomi O. Lawrence filed a complaint  Aug. 29 in the Court of Common Pleas of Lancaster County against NPC International INC., alleging negligence. 

According to her complaint, Lawrence, who was 88 years old at the time, was at the Wendy's on Peter's Road in Lititz owned by the defendant. She claims as she walked to the soda fountain with her tray of food, she slipped on the wet floor, landed on her shoulder and hit her head on the floor. 

Lawrence claims she suffered a fractured/dislocated humerus, received seven stitches for a laceration above her eye and required two months stay at a rehab facility as well as surgery. She alleges the defendant's negligence for failing to reasonably inspect the floor or warn of the dangerous condition with barricades, cones or signage. 

Lawrence also claims the defendant was negligent for failing to remove the accumulated water and allowing it to remain despite knowing the area was slippery to patrons. She further claims as a result of her slip and fall, she has lost her independence and has been forced to move into an assisted living facility as well as incurring medical expenses beyond her Medicare cap. 

Lawrence seeks monetary relief of more than $50,000, interest and all other just relief. She is represented by Mark Lovett of Brubaker Connaughton Goss & Lucarelli LLC in Lancaster.
