Lawsuit filed after 7-year-old trying to climb a tree falls

PITTSBURGH - An apartment complex owner is blamed for a 7-year-old tenant using its building materials to try to climb a tree, only to fall and seriously injure himself.

A minor filed a lawsuit Feb. 26 against 2013 PA Brushton LLC, also known as Homewood North Apartments, and Eureka Multifamily Group L-P., for failing to maintain their premises. 

The case was filed in the Court of Common Pleas of Allegheny County through lawyer Paul G. Mayer Jr. of Friday & Cox,

According to the complaint, the defendants left building materials outside of an apartment unit, and children were using them to help them climb a nearby tree. The suit blames the defendants for not posting warnings that building materials shouldn't be used to climb trees.

The plaintiff lost her balance and fell onto bricks at the base of the tree, resulting in head injuries, seizures and speech difficulties, the suit says.
