Outback sued over slippery stool, spilled soup

PHILADELPHIA - A federal lawsuit against Outback alleges back injuries from a stool that slipped out from under a customer.

Outback Steakhouse is facing a lawsuit filed Feb. 29 by Paul Caskey, a Pennsylvania resident who suffered serious injuries in a fall incident at the restaurant's Royersford location. The case was filed in the United States District Court for the Eastern District of Pennsylvania.

Caskey, represented by Gabriel Levin of Levin & Zeiger, alleges that Outback Steakhouse of Florida LLC and OS Restaurant Services LLC are responsible for his injuries. 

The complaint states that the barstool he sat on when eating dinner with his wife in July 2022 did not have any type of slip-resistant material on its feet, causing it to slide rapidly backwards when he leaned over the bar.

The plaintiff asserts that the defendants were aware of this potential danger and had been warned about the slipperiness of the barstool prior to his fall. However, they failed to provide any warning to him.

As he fell backwards, he says he spilled soup on himself.
