Plaintiff alleges negligence by Lansdowne Gardens LP and Upper Darby Township leading to severe injuries

In a recent civil action complaint, Javaun Burrell has filed a lawsuit against Lansdowne Gardens LP and Upper Darby Township, alleging negligence that resulted in severe bodily injuries. The complaint was filed on May 17, 2024, in the Court of Common Pleas of Delaware County.

According to the details outlined in the case, on July 20, 2023, Burrell was walking along Radbourne Road in Upper Darby when a tree located at 7258 Radbourne Road fell onto him. The plaintiff claims that the tree was in a hazardous condition due to poor maintenance and lack of reinforcement. This incident led to Burrell being knocked to the ground and sustaining serious injuries including disc bulging at C3-4 and C4-5, bilateral C5-6 radiculopathy, and ongoing pain in his neck, back, left elbow, and left foot.

The complaint asserts that Lansdowne Gardens LP had ownership and control over the property where the tree was located. It alleges that the company failed to maintain the tree properly or provide adequate warnings about its dangerous condition. "Defendant Lansdowne Gardens LP did carelessly and negligently create, allow to remain and otherwise fail to properly address or warn of said hazardous condition," states the complaint.

Furthermore, Burrell's legal team argues that Upper Darby Township also bears responsibility for failing to ensure public safety on sidewalks under its jurisdiction. The township is accused of neglecting its duty to inspect and address hazards such as unstable trees threatening pedestrian pathways. "Defendant Upper Darby Township did carelessly and negligently create, allow to remain and otherwise fail to properly address or warn of said hazardous condition," reads another section of the filing.

Burrell seeks monetary compensation not exceeding $50,000 from each defendant for medical expenses incurred due to his injuries as well as for future medical costs. He also seeks compensation for loss of earnings, physical pain, mental anguish, emotional distress, loss of enjoyment of life, discomfort, inconvenience, limitation of movement among other damages.
