Plaintiffs Allege Delaware County Election Fraud Due to Uncertified Voting Machines

**Election Integrity Under Scrutiny: Federal Lawsuit Alleges Massive Fraud in Delaware County**

In a dramatic turn of events, a group of pro se plaintiffs has filed a federal lawsuit against Delaware County and its Board of Elections, alleging widespread election fraud facilitated by uncertified voting machines. The complaint was filed on June 5, 2024, in the United States District Court for the Eastern District of Pennsylvania by Robert Mancini, Joy Schwartz, Gregory Stenstrom, and Leah Hoopes.

The plaintiffs argue that the voting machines used in Delaware County have not been tested or certified according to federal law, specifically citing violations of 52 USC 21081(a)(5) concerning error rates. They claim these violations have enabled massive election fraud that has deprived them and other citizens of their constitutional rights to fair elections. "Plaintiffs have hard, physical evidence, witness affidavits, court testimony, and admissions by public officials," the complaint states.

According to the lawsuit, the defendants failed to perform secure-build validation or "hash testing" on their voting machines. This omission allegedly leaves no guarantee that the software used matches what was tested and approved by the Pennsylvania Department of State. During a hearing on May 24, 2023, James P. Allen, Director of Elections for Delaware County, admitted under oath that such testing was not performed before the November 2022 election.

The plaintiffs recount numerous legal battles where they sought transparency and compliance with election laws but were repeatedly thwarted by local courts. In one instance cited in the complaint (Delaware County v Robert Mancini), Mancini successfully petitioned for public election records only to have those orders reversed by the Delaware County Court of Common Pleas.

Further exacerbating their claims are allegations that James Savage inserted USB v-cards into tabulation servers days after an election without proper chain-of-custody protocols. The plaintiffs also accuse local judges and public officials of obstructing investigations into these alleged violations.

The relief sought includes an injunction to prevent the use of electronic voting systems in future elections unless compliance with federal laws can be assured. They propose a return to hand-counted votes at precinct levels under bipartisan observation as an alternative solution. Additionally, they seek federal oversight over previous cases delayed or dismissed at local levels and monetary damages for their efforts to expose these issues.

Representing themselves pro se are Robert Mancini from Media, PA; Joy Schwartz from Drexel Hill; Gregory Stenstrom from Glen Mills; and Leah Hoopes from Chadds Ford. The case is being overseen by Judge KNS under Case No. 2:24-cv-02425-KNS.
