A tragic case of alleged negligence has surfaced in Delaware County, where the estate of a young boy is suing his father and a babysitter for wrongful death. The complaint was filed by Jacquelyn S. Goffney, Esquire, as the administrator of the Estate of Kevin Jamison Martin, and Lisa Earl on June 13, 2024, against Kevin Martin and Madison Snyder.
The lawsuit centers around the unfortunate drowning of three-year-old Kevin Jamison Martin on June 17, 2022. According to the complaint, the young boy drowned after entering a hot tub attached to a swimming pool at his father's residence located at 34 Pennrose Talley, Garnet Valley, PA. The plaintiffs argue that both defendants had duties to protect Kevin from foreseeable harm but failed to do so.
The plaintiff's mother, Lisa Earl, claims that she had previously warned Kevin Martin about the dangers posed by the pool area after learning that her son had fallen into the pool weeks before his death and needed to be rescued. Despite these warnings and pleas for closer supervision and safety measures such as life vests, it is alleged that no adequate actions were taken.
Furthermore, it is stated that Kevin Martin hired Madison Snyder as a babysitter despite knowing she lacked proper training in water safety and did not adequately supervise young Kevin near the pool area. On the day of the incident, while Kevin Martin was not home, Madison Snyder allegedly allowed children to play around the swimming pool and hot tub without proper supervision. This lapse in attention led to young Kevin entering the hot tub and tragically drowning.
The plaintiffs are seeking judgments against both defendants for their alleged negligence which they claim resulted in extreme physical pain and suffering for their decedent before his death. They also cite mental anguish endured by family members due to this preventable tragedy. The lawsuit demands compensatory damages exceeding $50,000 from each defendant along with interest and costs of suit.
