On June 12, 2024, Shaunte Palmer filed a complaint in the Delaware County Court of Common Pleas against Crozer Chester Medical Center and its associated entities, including Crozer Health, Prospect DCMH LLC, and Prospect Crozer LLC.
According to the complaint, Palmer was injured on June 13, 2022, due to what she describes as a dangerous and defective condition at the Crozer Chester Medical Center. The lawsuit alleges that the defendants negligently allowed water to accumulate on the bathroom floor due to a leak in the plumbing or ceiling. This hazardous condition allegedly caused Palmer to slip and fall, resulting in severe injuries including closed head injury, back injury, neck injury, left radial sensory neuropathy, cervical disc injuries, lumbar disc injuries, and other musculoskeletal issues.
Palmer's attorney, Keith W. Kofsky of Clearfield & Kofsky law firm, argues that the defendants failed in their duty to maintain safe premises for business invitees like Palmer. "The negligence and carelessness of the Defendants consisted of allowing an improperly repaired ceiling and/or roof to remain on the premises," states the complaint. It further accuses the defendants of failing to warn about or rectify the hazardous condition despite being aware of it.
The lawsuit outlines multiple counts against various parties involved in maintaining the property. These include general negligence claims against Crozer Chester Medical Center and its associated entities as well as specific claims against unknown contractors referred to as John Doe 1-3. The plaintiff contends that these unnamed parties may have been responsible for maintaining structural components such as plumbing and ceilings but failed to do so adequately.
Palmer is seeking judgment for damages not exceeding arbitration limits plus interest and costs. She claims ongoing pain and suffering along with financial burdens from medical expenses and loss of earnings due to her injuries. The complaint emphasizes that these damages are directly attributable to the defendants' failure to exercise reasonable care under circumstances that posed foreseeable risks.
