Pittsburgh Couple Sues UPMC Facilities Over Hazardous Conditions Leading to Severe Injuries

A lawsuit filed by a Pittsburgh couple alleges negligence and unsafe conditions at two prominent UPMC facilities, resulting in severe injuries. On July 1, 2024, Kelly Vietmeier and Glenn Vietmeier lodged a complaint in the Court of Common Pleas of Allegheny County against UPMC Rooney Sports Complex and UPMC Presbyterian.

The plaintiffs claim that on September 12, 2023, Kelly Vietmeier suffered significant injuries due to hazardous conditions at the UPMC Rooney Sports Complex. The complaint details how Kelly and her husband Glenn parked near the facility's entrance when she slipped on a dangerously slippery sidewalk caused by poor maintenance and a broken water sprinkler. The accumulation of water had created an oily, ice-like surface that led to her fall. According to the filing, "the defective condition had remained on the property for an extended period," making it impossible for Kelly to avoid the hazard despite exercising due care.

The lawsuit accuses UPMC Rooney Sports Complex and UPMC Presbyterian of failing to maintain safe premises, citing numerous lapses such as improper sloping of sidewalks, broken sprinklers leading to water pooling, and general disrepair. These failures allegedly resulted in dangerous conditions that posed risks to business invitees like Kelly Vietmeier. The plaintiffs argue that the defendants neglected their duty to inspect and maintain the premises adequately or provide warnings about these hazards.

Kelly Vietmeier sustained multiple injuries from her fall, including lumbar disc bulges with fissures, contusions, decreased range of motion, weakness, numbness, swelling, bruising, scarring, severe shock, strain or sprain of muscles and ligaments. As a result of these injuries, she has endured pain and suffering and incurred substantial medical expenses. Additionally, Glenn Vietmeier claims loss of consortium due to his wife's injuries.

The plaintiffs seek compensatory damages exceeding the arbitration limits of Allegheny County for medical expenses, pain and suffering, loss of enjoyment of life for Kelly Vietmeier; as well as damages for loss of consortium for Glenn Vietmeier.
