Customer Sues Major Retailer Over Alleged Negligence Leading to Severe Injuries

A recent court filing has thrust a major retail corporation into the spotlight, alleging negligence that led to severe injuries for a customer. Ayla Bey filed a complaint against Walmart Inc. in the Court of Common Pleas of Allegheny County, Pennsylvania, on June 28, 2024.

The case revolves around an incident that occurred on November 22, 2023, at approximately 5:00 p.m., when Bey entered Walmart Store #5040 located at 2200 Washington Pike, Carnegie, PA. According to the complaint, Bey slipped and fell due to a shattered glass jar of gravy that had spilled onto the floor, creating a hazardous condition. The plaintiff asserts that there were no caution signs or warnings in place to alert customers about the spill.

Bey's attorney, Laura R. Signorelli from Morgan & Morgan Philadelphia PLLC, argues that Walmart and its subsidiaries failed in their duty to maintain safe premises for their customers. "Defendants had a duty to inspect, maintain, repair, control, supervise and/or oversee the at-issue premises and to warn of and correct any dangerous condition thereon," states the complaint. The lawsuit claims that Walmart's negligence directly resulted in Bey sustaining multiple injuries including a mild concussion, back pain necessitating injections, severe pain, decreased range of motion, weakness, numbness and tingling among others.

The plaintiff is seeking judgment for damages against Walmart Inc., Wal-Mart Stores East L.P., Wal-Mart Store #5040 and Wal-Mart Supercenter. The relief sought includes compensation for medical expenses both past and future, lost wages due to impaired earning capacity, pain and suffering as well as other associated costs exceeding the jurisdictional limits of compulsory arbitration.
