Dunmore Schools sued after sexually explicit film of student is passed around

SCRANTON - The parents of a student at Dunmore Middle School have sued the district after they say a sexually explicit video of him was allowed to be shared by students.

A lawsuit was filed July 12 in the United States District Court for the Middle District of Pennsylvania by parents on behalf of their minor son, JH, against the Dunmore School District and several individuals. 

The plaintiffs allege that JH, a special education student with Autism Spectrum Disorder, was filmed without his consent while engaging in a private act in a school bathroom. 

The video was then disseminated among students via Apple AirDrop, Snapchat, and text messages. The lawsuit claims that the school district and its employees failed to enforce policies regarding cell phone use and did not adequately investigate or address the incident when it was reported. 

The plaintiffs are seeking compensatory and punitive damages for violations of JH's civil rights under Section 1983, the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act, Title IX, and related state laws.
