Hotel Chain Accused of Negligence After Guest Suffers Severe Injuries

A man has filed a lawsuit against a hotel, alleging severe injuries due to negligence. Anthony Wright lodged the complaint on July 24, 2024, in the Court of Common Pleas of Delaware County, PA, targeting Ellis Straw Party Retail/Hotel LP, operating as Hilton Garden Inn.

According to the complaint, Wright was staying at the Hilton Garden Inn located at 3743 West Chester Pike in Newtown Square when he experienced a life-altering incident on October 24, 2022. While using the bathroom in room 103, the safety bar in the shower/tub area detached from the wall. This sudden failure caused Wright to fall and sustain significant injuries to both his hands and fingers. The lawsuit claims that these injuries are not only serious but also permanent.

Wright's legal team, led by Justin M. Bernstein of Kenneth R. Schuster & Associates, P.C., argues that the hotel was grossly negligent in maintaining its property. The complaint asserts that there were no warning signs indicating that the safety bar was defective or dangerous. "The dangerous and defective conditions were present due to Defendants’ failure to properly maintain the property in a safe condition for those using the shower/tub area," reads one part of the document.

Furthermore, Wright contends that Ellis Straw Party Retail/Hotel LP and other unnamed corporate entities (referred to as John Doe Corporations 1-10) had actual or constructive knowledge of these hazardous conditions but failed to take corrective action. The plaintiff believes that as a business invitee, he was owed "the highest duty of care" by the defendants who had exclusive control over the property.

The lawsuit lists multiple counts of negligence against all defendants involved. These include failing to inspect and repair the defective safety bar and failing to warn patrons about its dangerous condition. As a result of this alleged negligence, Wright claims he has suffered severe pain and suffering, permanent injuries, emotional distress, lost wages, and diminished earning capacity.

Wright is seeking judgment in excess of $50,000 plus interest, costs, and delay damages. He aims for compensation covering medical expenses related to his treatment and rehabilitation as well as future medical needs stemming from his injuries.
