PITTSBURGH - A contractor faces wrongful death litigation after a railing on a deck built by it allegedly wasn't secure, leading a man to fall to his death.
A lawsuit was filed in July in the Court of Common Pleas of Allegheny County by Hannah Clyburn, administratrix of the estate of her deceased husband, Lance Gerald LaDuke.
The defendant in the case is Bonura Construction, LLC. The complaint alleges that Bonura Construction negligently constructed a porch and railing at Clyburn's residence, leading to LaDuke's fatal fall on November 22, 2023.
The railing, it alleges, was not secured, causing LaDuke to fall on a concrete driveway. He had tripped at the top of the porch's steps and stumbled into the railing.
LaDuke suffered massive head trauma from the fall and subsequently died on December 10, 2023. The plaintiff claims damages under both the Pennsylvania Survival Act and the Pennsylvania Wrongful Death Act.
