HARRISBURG - The Ohio brewery Urban Artifact is arguing in federal court that Pennsylvania's restrictions on deliveries by out-of-staters are illegal.
Grayscale Brewing LLC, operating as Urban Artifact, filed a lawsuit July 17 against Pennsylvania state officials in the United States District Court for the Middle District of Pennsylvania.
The plaintiff alleges Pennsylvania's beer shipping laws discriminate against out-of-state breweries, violating the dormant Commerce Clause of the U.S. Constitution.
The complaint highlights that while in-state breweries can ship unlimited quantities of beer directly to consumers, out-of-state breweries face restrictive quantity limits and additional licensing requirements.
Urban Artifact seeks a declaratory judgment deeming these laws unconstitutional and an injunction to prevent their enforcement.
