Tenant Alleges Negligence Against Apartment Complex Over Hazardous Conditions

A tenant is suing her landlord over alleged negligence that led to a serious injury. On August 14, 2024, Onisha Fletcher filed a complaint in the Court of Common Pleas of Delaware County against Stonehurst Apts LLC, alleging that their failure to maintain safe premises resulted in her suffering significant injuries.

According to the complaint, Fletcher was a tenant at Stonehurst Apartments located at 7250 Walnut Street, Upper Darby, PA. On October 30, 2022, she was descending an exterior stairway on the property when she slipped and fell due to the broken, cracked, and crumbling condition of the stairs. The lawsuit claims that this dangerous condition had been present for an unreasonably long time and that Stonehurst Apts LLC had failed to take necessary actions to repair or warn tenants about it.

Fletcher's attorney, Jared S. Zafran of Zafran Law Group, argues that Stonehurst Apts LLC had a duty to ensure the safety of its premises through regular inspections and timely repairs. "The defendant neglected their responsibility to maintain safe conditions for their tenants," Zafran stated in the filing. The complaint further alleges that Stonehurst Apts LLC either knew or should have known about the hazardous condition but failed to act accordingly.

The plaintiff is seeking damages not exceeding $50,000 for medical expenses related to her right shoulder, right wrist, and back injuries sustained from the fall. Additionally, Fletcher claims she has suffered emotional distress and loss of life's pleasures due to her injuries. She also seeks compensation for lost wages and diminished earning capacity resulting from her inability to work post-accident.
