Plaintiff Alleges Negligence Against Hotel Operators Following Severe Injury

A Pennsylvania woman has filed a lawsuit against multiple defendants for injuries sustained due to alleged negligence on their premises. Desiree Whitfield filed the complaint in the Court of Common Pleas, Delaware County, on June 4, 2024, naming J.R. & Sons, Inc., McIntosh Motor Inns, Inc. (doing business as Quality Inn), Mukeshkumar Patel (also known as Mukesh Patel), and Vimal Patel (also known as Milan Patel) as defendants.

The case revolves around an incident that occurred on January 28, 2023, when Whitfield was legally present at a property located at 4 S. New Middletown Road in Media, PA. According to the complaint, Whitfield suffered severe and permanent bodily injuries due to a loose and/or shifting landing in the staircase on the third floor of the premises. The plaintiff alleges that her injuries were a direct result of the defendants' negligence in maintaining safe conditions on their property.

Whitfield's attorney, Marc F. Greenfield of Spear, Greenfield, Richman, Weitz & Taggart P.C., detailed several accusations against the defendants. These include failure to properly design, construct, maintain, and repair the premises; failure to monitor and inspect for dangerous conditions; failure to provide adequate warnings about potential hazards; and non-compliance with building codes and regulations. The complaint also accuses the defendants of failing to exercise reasonable care under foreseeable dangerous circumstances and disregarding known hazardous conditions despite being aware of their potential to cause serious harm or death.

In her filing, Whitfield claims that these failures led to her suffering various serious and permanent personal injuries including impairment of body function and emotional distress. She asserts that she has experienced significant pain and suffering since the incident and anticipates ongoing physical agony and emotional trauma. Additionally, Whitfield contends that her ability to earn income has been severely impacted by her injuries.

The plaintiff is seeking judgment against each defendant in an amount not exceeding $50,000 plus all reasonable costs associated with the case. She is also requesting compensation for medical expenses incurred due to her injuries which are not covered by health insurance.
