A woman’s dining experience turned into a dental nightmare, leading to a lawsuit against a well-known entertainment venue. On August 30, 2024, Kacy Fritz filed a complaint in the Court of Common Pleas of Allegheny County, Pennsylvania, against Holdings Acquisition Co. L.P., the owner and operator of Rivers Casino.
According to the complaint, on November 14, 2023, Kacy Fritz visited the Wheelhouse restaurant located within Rivers Casino for dinner. While enjoying her wedding soup, she unexpectedly bit into a large bone hidden in the soup. This incident resulted in three cracked molars and lacerations to her gums. The plaintiff alleges that this painful and distressing experience necessitated immediate dental attention and will require extensive dental procedures including two root canals and crowns.
Fritz’s attorney, Anthony E. Patterson, asserts that Holdings Acquisition Co. L.P. failed in its duty of care by allowing dangerous conditions to exist on its premises. The lawsuit claims that the defendant was negligent in several ways: failing to properly inspect and ensure food safety, not maintaining safe premises for patrons, and not warning customers about potential hazards. “Defendant Holdings Acquisition knew or should have known of the dangerous conditions,” reads the complaint.
The lawsuit further accuses Holdings Acquisition Co. L.P. of outrageous misconduct and reckless disregard for patron safety by not preventing food contamination despite having policies against it. The plaintiff seeks compensatory damages exceeding arbitration limits for pain and suffering, medical expenses, emotional trauma including PTSD and depression, permanent scarring and disfigurement from necessary surgeries, loss of enjoyment of life’s pleasures, and lost wages due to inability to work.
In addition to compensatory damages, Fritz is also seeking punitive damages due to what she describes as willful misconduct by Holdings Acquisition Co. L.P., which allegedly exhibited extreme reckless indifference towards its business invitees’ rights.
