Plaintiff alleges LVNV Funding (debt collector) violated Fair Debt Collection Practices Act

Ricardo Altreche has taken legal action against LVNV Funding, LLC, alleging violations of the Fair Debt Collection Practices Act (FDCPA). The complaint was filed in the Court of Common Pleas of Allegheny County, Pennsylvania, on October 24, 2024. Altreche accuses LVNV Funding of providing false and misleading information regarding a disputed debt to credit reporting agencies.

The case traces back to November 15, 2023, when LVNV Funding initiated a civil complaint against Ricardo Altreche in Magisterial District Court. This resulted in a default judgment against Altreche on May 31, 2024. Following this judgment, Altreche enlisted J.P. Ward & Associates to contest the allegations. On June 27, 2024, his attorneys sent a "First Dispute Letter" to LVNV Funding asserting that Altreche denied owing any money and instructed them to cease direct communication with him. Despite this notification, LVNV Funding allegedly reported inaccurate information about the debt status to TransUnion on August 6, 2024.

Altreche's lawsuit claims that LVNV Funding's actions violated multiple provisions of the FDCPA by falsely representing the character and legal status of the alleged debt and failing to communicate its disputed nature. Specifically, these actions are said to contravene sections 1692e(2)(a) and 1692e(8) of the FDCPA which prohibit false representations concerning debts and mandate accurate communication about disputed debts.

The plaintiff seeks monetary damages for actual harm suffered due to these violations including emotional distress and inconvenience. Additionally, he requests statutory damages as allowed under section 1692k(a) of the FDCPA along with costs and attorney fees.
