Insurance Company Sues Drivers Over Negligence in Costly Car Accident

Permanent General Assurance Corporation has filed a lawsuit against two individuals following a motor vehicle accident that resulted in significant property damage. The complaint was filed by Douglas G. Aaron, Esquire, on behalf of Permanent General Assurance Corporation in the Delaware County Court of Common Pleas. The defendants named in the suit are Porsche Davis and Ahmir Rogers-Davis.

The case revolves around an incident that occurred on June 21, 2024, when a vehicle insured by Permanent General Assurance Corporation and owned by Tresia and Khalil Smith Rawls was involved in an accident on I-476 in Marple Township, Pennsylvania. According to the complaint, the vehicle driven by Ahmir Rogers-Davis, which belonged to Porsche Davis, collided with the insured's car due to negligence and carelessness. The plaintiff claims that this negligence led to property damages amounting to $11,435.78 as well as rental expenses totaling $750.00.

The complaint outlines several allegations against the defendants, including failure to maintain a proper lookout, failure to yield the right of way, failure to keep an assured clear distance, failure to obey traffic rules, and negligent entrustment of their vehicle. The plaintiff asserts that these actions were solely responsible for the accident and subsequent damages.

Permanent General Assurance Corporation is seeking a judgment against both defendants for a total amount of $12,185.78 plus interest and costs. This sum represents the combined property damage and rental expenses incurred as a result of the accident. The insurance company is pursuing subrogation rights against the defendants jointly and severally.
