According to the lawsuit, Rafael Motta claims that while walking down East Carson Street on December 18, 2022, he slipped on an untreated icy sidewalk in front of The Revival on Carson Apartments. This incident allegedly resulted in multiple injuries including a kneecap fissure, hand and wrist injuries, bruising and hematoma on his hand, lower back pain, and upper rib pain. Motta asserts that these injuries have not only required medical attention but have also impaired his ability to work as much as before due to owning a professional cleaning business. Furthermore, he states that his general health and daily routines have been significantly affected.
Motta's attorney, Matthew J. Scanlon of Scanlon & Wojton LLC, argues that the defendants failed in their duty to maintain safe conditions for pedestrians by neglecting to shovel or salt the icy sidewalk despite being aware of forecasted inclement weather.
