A Pennsylvania resident is embroiled in a legal battle against a debt collection company over allegations of improper credit reporting. Stephen P. D’Amicantonio filed a complaint on December 11, 2023, in the Court of Common Pleas of Allegheny County, Pennsylvania, against Absolute Resolutions Investments, LLC.

The lawsuit stems from an alleged debt amounting to $4,127.08 that Absolute Resolutions Investments claimed D’Amicantonio owed. However, after the defendant initiated legal proceedings in Delaware County on October 31, 2023, judgment was entered in favor of D’Amicantonio on December 11, 2023. Despite this ruling, Absolute Resolutions reportedly continued to report the debt to credit agencies as outstanding and legally owed by D’Amicantonio. This has led to accusations that the company violated several consumer protection laws.

D’Amicantonio's complaint accuses Absolute Resolutions Investments of breaching the Fair Debt Collection Practices Act (FDCPA) by misrepresenting the status and amount of the debt in violation of 15 U.S.C § 1692e(2)(A) and failing to update credit agencies with accurate information per 15 U.S.C § 1692f. Furthermore, he claims violations under the Fair Credit Extension Uniformity Act (FCEUA) and the Unfair Trade Practices and Consumer Protection Law (UTPCPL), arguing that these actions caused him ascertainable damages.

In his pursuit for justice, D’Amicantonio seeks various forms of relief from the court. He requests compensatory damages for emotional distress and statutory damages for FDCPA violations. Additionally, he demands treble damages under both FCEUA and UTPCPL claims alongside attorney’s fees and costs associated with litigation. The complaint also seeks punitive damages under the Fair Credit Reporting Act (FCRA) for failing to investigate or rectify disputed charges.
