Insurance Company Alleges Negligence Against Motorist in Subrogation Claim

A civil lawsuit has been filed in Delaware County, Pennsylvania, alleging negligence and carelessness in a motor vehicle accident. Nationwide General Insurance Company initiated the complaint on December 11, 2024, against Miguel Ayala Delgado. The case revolves around an incident that occurred on December 2, 2023, involving a vehicle insured by Nationwide and owned by Jean Claude Darcisse.

According to the complaint filed by Nationwide General Insurance Company at the Court of Common Pleas in Delaware County, the defendant, Miguel Ayala Delgado, is accused of causing a motor vehicle accident through negligent and careless driving. The plaintiff claims that Delgado's actions resulted in significant property damage to Darcisse's lawfully parked vehicle on Hollis Avenue in Crum Lynne, Pennsylvania. The insurance company asserts that Delgado failed to maintain proper control of his vehicle, neglected to yield the right of way, and did not adhere to traffic regulations.

The plaintiff further alleges that Delgado's negligence led to property damages amounting to $4,740.56 and rental expenses totaling $450.00 for which Nationwide was obligated to compensate under its insurance contract with Darcisse. The insurance company is seeking subrogation against Delgado for these amounts. In addition to the financial claims, Nationwide contends that Delgado either operated the vehicle himself or allowed someone incompetent to drive it on his behalf.

Nationwide General Insurance Company is demanding a judgment from the court for a total of $5,190.56 plus interest and costs incurred due to the alleged negligence of Miguel Ayala Delgado. The legal action seeks relief through reimbursement for damages paid out under their policyholder’s coverage as well as any additional expenses related to this incident.
