A Pennsylvania resident has taken legal action against a major automobile manufacturer, alleging multiple breaches of warranty and consumer protection laws. On October 2023, Dale E. Peck filed a complaint in the Court of Common Pleas of Allegheny County against FCA US LLC, seeking redress for ongoing vehicle defects.

The case centers around a 2022 RAM 1500 leased by Peck on November 11, 2022. The plaintiff contends that the vehicle, manufactured and warranted by FCA US LLC, exhibited significant mechanical issues soon after purchase. Despite multiple repair attempts, problems such as transmission failures and electrical malfunctions persisted. Peck claims these defects have substantially impaired the vehicle's use, safety, and value.

Peck's lawsuit asserts violations of several statutes including the Pennsylvania Automobile Lemon Law and the Magnuson-Moss Warranty Act. The Lemon Law mandates manufacturers to correct nonconformities within a year or before the vehicle reaches 12,000 miles. According to Peck's complaint, FCA US LLC failed to resolve these issues despite numerous repair attempts documented between March and September 2024.

Additionally, Peck accuses FCA US LLC of breaching the Magnuson-Moss Warranty Act by not honoring express written warranties provided at the time of sale. This federal law supports state warranty enforcement and prohibits disclaimers if an express warranty is offered. The plaintiff argues that FCA US LLC did not adequately address the vehicle's defects within a reasonable timeframe or number of attempts.

The complaint also alleges violations under Pennsylvania’s Unfair Trade Practices and Consumer Protection Law. Peck claims that FCA US LLC misrepresented the quality and reliability of their product and failed to comply with their own warranty terms. Such actions are classified as "unfair or deceptive acts" under state law.

Peck seeks judgment against FCA US LLC for an amount equivalent to the purchase price of the vehicle plus collateral charges not exceeding $50,000. The plaintiff also requests compensation for incidental damages along with attorney fees and court costs.
