The complaint was filed by Matthew Flynn on January 9, 2025, in the Court of Common Pleas of Delaware County against Randall McMahon and Kristine Courtney Fernandez, along with several unnamed defendants.
According to the details outlined in the court documents, Matthew Flynn accuses the defendants of negligence after he was bitten by their dog on January 11, 2023. Flynn was at the defendants' property to escort their child to a school bus when he was attacked by what appeared to be a brown pit bull mix. The lawsuit alleges that Flynn had permission to be on the premises and should have been considered an "invitee," thereby obligating the defendants to ensure his safety from such attacks.
Flynn's complaint lists multiple instances of alleged negligence on the part of McMahon and Fernandez. These include maintaining a dog known for its vicious character, failing to warn or protect Flynn from potential attacks, not restraining or controlling the dog adequately, and violating Pennsylvania's Dog Laws including section 459-502-A of the Dog Bite Statute. The document also claims that these actions led directly to Flynn suffering severe physical injuries, emotional distress, and financial losses due to medical expenses and an inability to work.
The plaintiff is seeking damages not exceeding $50,000 for his injuries which include permanent scarring and emotional trauma.
