The complaint was filed by Erie Insurance Exchange in the Court of Common Pleas of Allegheny County, Pennsylvania, on January 17, 2025, naming Diana Jaden and Angela Romonovich as defendants.
The case revolves around an incident that occurred on September 25, 2024. According to the complaint, a vehicle rented by Diana Jaden and operated by Angela Romonovich crashed into a property insured by Erie Insurance Exchange, causing significant damage. The property belongs to Dee Briggs and is located at 1412 Swissdale Avenue in Wilkinsburg, Pennsylvania. Erie Insurance claims that the collision was due to the defendants' negligence and carelessness. Specific allegations include failing to maintain a proper lookout, not yielding the right of way, failing to keep an assured clear distance, disobeying traffic rules, driving at an unreasonable speed under the circumstances, improper brake application, lack of vehicle control, and negligent entrustment of the vehicle to an incompetent driver.
Erie Insurance Exchange argues that it had to cover damages amounting to $21,254.98 due to this incident. As per their insurance contract with Dee Briggs, they are now seeking subrogation against Jaden and Romonovich for this amount. The insurance company has provided evidence of payments made to cover these damages as part of their filing.
In addition to recovering the cost of damages paid out under its policy with Dee Briggs, Erie Insurance is also seeking interest and costs associated with the lawsuit from both defendants jointly and severally. This means they are asking for a judgment where each defendant could be held responsible for the full amount.
