Patient Alleges Medical Device Makers Negligence Led to Severe Health Complications

Barbara Marshall has filed a lawsuit against two major corporations, alleging that their medical device caused her significant harm. The complaint was lodged in the Court of Common Pleas of Allegheny County, Pennsylvania, targeting C.R. Bard, Inc., and its subsidiary Bard Peripheral Vascular, Inc., on an unspecified date but involving events as recent as January 31, 2023.

The case revolves around a medical device known as the G2 Filter System, designed to prevent blood clots by being implanted into patients' inferior vena cava. Barbara Marshall claims that after having this device implanted following a car accident in 2004, it malfunctioned dramatically years later. On January 31, 2023, she discovered that two struts from the filter had broken off; one had migrated to her heart and another to her kidney. Although the main filter was removed surgically, the struts could not be extracted without risking severe injury. This situation has left Marshall with ongoing medical issues and anxiety about potential future complications.

Marshall's complaint accuses C.R. Bard and Bard Peripheral Vascular of negligence and failing to warn users about the risks associated with their product. She asserts that both companies were aware of similar devices fracturing but did not inform healthcare providers or patients about these dangers or how to mitigate them. "The Defendants knew or should have known at the time they manufactured...that the G2 Filter System posed a significant risk for failure," states the complaint. As a result of this alleged negligence, Marshall has suffered extensive medical expenses, pain and suffering, mental anguish, and loss of enjoyment of life.

In her lawsuit, Marshall seeks compensation for these damages within the arbitration limits set by Allegheny County's legal system. Her demands include coverage for past and future medical expenses related to monitoring and potentially treating complications from the fractured device components.
